This Practice Direction will come into effect on date of issue. It may be cited as ‘Tribunal Practice Direction No.2 of 2011 -Video Conference Hearings’. It may be abbreviated to TPD 002/2011.
Degree No 57 of 2009 concerning the Establishment of Special Tribunal,as amended by Decree No.11 of 2010;and
The Rules of the DIFC Courts.
I hereby direct as follows:
(1) All applications or claims to the Tribunal(including to a single number or to the Registrar) shall be made at the offices of Special Tribunal or elsewhere in Dubai as may be directed.A member of the Tribunal may be present by video link in the following circumstances: –
(a) a single member of the Tribunal hearing an application or claim under TPD 001/2011 may hear the application or claim by video link if that member considers it appropriate to do so;
(b)where two members of the Tribunal hear an application or claim under TPD 001/2011.one member may be present by video link if they consider it appropriate in all the circumstances of the case, provided that the member present in person shall preside over the hearing;and
(c)where three(or more) members of the Tribunal hear an application or claim, one member only may be present by video link if they consider it appropriate in circumstances of the case,provided that a member present in person shall preside over the hearing.
(2) For the avoidance of doubt, the Tribunal may permit counsel to appear for a party by video link to the hearing in Dubai, but the power in unlikely to be exercised save in unusual or exceptional circumstances.
